Abstract
Die Europäische Union (EU) steht regelmäßig in der Kritik, ihre Kompetenzen zulasten der Mitgliedstaaten zu erweitern. Der Essay zeigt am Beispiel der Debatte um die EU-Mindestlohnrichtlinie, dass die weit verbreitete Annahme eines „Competence Creep“ zu kurz greift, da sie das Spannungsverhältnis zwischen dem Prinzip der begrenzten Einzelermächtigung und wirksamem unionsrechtlichem Handeln unberücksichtigt lässt.
